Matthew Morgan Makes The Ballot

July 4th, 2025 Honorary Judge Lawrence Knipel rules in the favor of Matthew Morgan against the Board of Elections In The City of New York (Board).
Matthew Morgan`s petition had been ruled invalid by the Board of Election on June 4th due to a failure to attach a copy of the original cover sheet or the Non-Compliance Notice when the petitioner submitted an amended cover due to the original being label invalid due to missing the petitioner`s printed name.
In regards to the missing printed name on the original cover sheet the court found that while the Board`s guidelines did required the printed name below or beside the signature on a cover sheet that "the Board had no authority to create such a requirement" and that "petitioner's original cover sheet was in substantial compliance with 9 NYCRR 6215.2 and 9 NYCRR 6215.8".
In regards to Morgan being kicked off the ballot due to the petitioner`s failure to attach the amended cover sheet to the Non-Compliance Notice or the original cover sheet the court found that "it is acadernic since petitioner never should have been required to file an amended cover sheet. the court further finds that the second cover sheet was in substantial compliance with 9 NYCRR 6215.7".
In conclusion the court ordered "that the Board place petitioner's name on the ballot for the November 4,2025, General Election for the public office of member of the New York City Council for the 39th Council District under the "Libertarian Party" party line"
